Almost 40 years since they stopped making music together the magic of the Beatles is still packing in audiences - at a Las Vegas casino. I'm just back still bleary-eyed with jet lag from a couple of weeks' holiday in the USA and for me the unquestioned bring out was my visit to see "like" the Cirque du Soleil show based on the music of the Beatles at the giant Mirage hotel on the Las Vegas Strip. The Liverpool Daily affix broke the story about this show being staged in Vegas and I had been intrigued by watching a South tip Show documentary on how it had been staged featuring Paul McCartney. Ringo Starr and their legendary producer Sir George Martin. So a visit to this show was at the top of my US desire list. I wasn't sure exactly what to expect. I grew up with the Beatles' music and I have always loved it but I still wasn't sure how I would act to seeing a troupe of French Canadian acrobats leaping about to their classic songs. I need not have worried. From its stunning opening with the stage exploding in colour and showering the audience with petals as "Get approve" break into life through moments of haunting beauty and frightening aerial athleticism accompanying songs like "Something" and "Octopus's Garden" to its emotional climactic "All you Need is like" this was a show to stir the senses like nothing I had seen before. On October 9. 2007. Las Vegas Sands Corp. (“Las Vegas Sands”) filed a lawsuit against Joshua Murega a California resident in the U. S. District act for the govern of Nevada. A copy of the complaint can be downloaded (courtesy of me). As most people who live in Las Vegas know. Las Vegas Sands operates. In addition. Las Vegas Sands holds numerous registered trademarks and service marks for various goods and services that are variants of the mark VENETIAN. Mr. Murega registered the domain names on or about August 29. 2007. On September 25. 2007. Las Vegas Sands’ discuss sent a cease and desist letter to Murega demanding that Murega cease all use of the domain names and that the domain names be transferred to Las Vegas Sands. Murega responded with a letter offering to assign the domain names “if your response is favorable.” It is not clear from the complaint what if anything happened after that. Las Vegas Sands alleges that the domain names were not registered in good faith and that Murega derives income from the links posted on the website. The complaint sets forth five counts: cybersquatting under 15 U. S. C. §1125(d) false designation of origin/unfair competition under 15 U. S. C. §1125(a) common law label infringement deceptive trade practices under NRS 598.0903 et seq. and intentional interference with prospective economic advantage. Las Vegas Sands is asking for an injunction prohibiting Murega from using the VENETIAN attach and from registering any more domain names containing the VENETIAN mark. Las Vegas Sands also requests an order to the domain label registrar of Murega’s domain names transferring the domain names to Las Vegas Sands. Finally. Las Vegas Sands asks for damages (compensatory consequential statutory exemplary and/or punitive) as well as interests costs and attorney’s fees. :Focusing on just the § 1125(d) cyber squatting count the law states that a domain label registrant is liable to a trademark owner if the registrant (i) registers traffics in or uses a domain label that a) is identical or confusingly similar to a distinctive mark or b) is identical or confusingly similar to or dilutive of a famous mark and (ii) has a bad faith intent to profit from that trademark including a personal name which is protected as a label under Section 43 of the Lanham Act. 15 U. S. C. § 1125(d)(1)(A). It is safe to say that Mr. Murega has registered and is using a domain name that is confusingly similar to and possibly even dilutive (for some of the domain names) of a famous mark. So his liability for cybersquatting rests of the question of bad faith. The law sets forth the nine factors that courts can consider in determining whether a person had a “bad faith intent to acquire.” See. I seriously doubt Mr. Murega can show any other trademark rights to the name. He has no prior use of the domain name in connection with a bona fide offering of any goods or services. Upon receiving Las Vegas Sands’ cease and desist letter he offered to transfer the sites without having used or having a bona fide attempt to use the domain name to offer any goods or services. Given the fame of the VENETIAN attach he could not undergo legitimately believed or had reasonable grounds to accept that the use of the domain name was a fair use or otherwise lawful. The combination of the evince VENETIAN with such words as weddings casinos shows and dining clearly shows a connection of the mark VENETIAN to the Las Vegas hotel and casino (and not as an adjective pertaining to Venice). Finally the complaint alleges that his domain names went to directory websites that provided "click-through" links to various other hotel websites which compete with The Venetian. All of these factors advance a finding of “bad faith intent to profit.”However. Mr. Murega may be setting up to assert a “fair use” defense. I did not download all of the exhibits to the complaint and therefore do not experience what the websites looked desire before today. But when I visited a few of Murega’s sites (the few that were even working) what I discovered was a page with a 10 back up countdown that said “You Are Being Redirected to The. .” (origin of gaming beautiful city of the world etc.) On this page (for at least one of the sites) there was a Vegas com banner ad that one could click on. But judges are not as naïve as you may think. They have a great deal of discretion in this area and will likely see this lame attempt to make some “bring together use” out of your website as further evidence that your original registration of such domains was indeed in bad faith. I rushed in to have a consume in the nearby restroom (as the kids had used up the hot water earlier) only to find that neither shower would work plus there were ants on the surprise and the whole restroom just looked old and grotty – not the standard I would evaluate when paying over $70 per night! We mentioned it to the girl in the office who said she would send housekeeping over but basically she couldn’t care less. After we got organised we walked over to the Circus. Circus Casino (KOA is right by it and move of it I think) and watched a couple of free circus acts which the kids enjoyed. Then we started walking drink Las Vegas Boulevard. ‘The Strip’. What immediately put me right off Vegas was these ‘business’ cards of prostitutes/strippers with act upon photos of themselves (just about naked) ALL over the displace – they were on low hedges walls stuck around rubbish bins and on the pedestrian crosswalk poles…really really sleazy. Fred also said that some of the people handing out these cards tried to transfer him one change surface though he was obviously with me & the kids! Next stop was the Mirage Casino where we saw a beautiful color tiger prowling around his luxurious enclosure… though he looked a little bored. Then we went to Denny’s for dinner which was very nice & served by a friendly joking waiter. I tried some Pumpkin pie for dessert for the first time it was quite tasty and not what I had expected. But the time we’d finished dinner it was almost dark and the neon lights had go on. We walked down to the ‘Treasure Island’ Casino to see their nightly pirate/siren show – very crowded when we got there & hard for the kids to see…which was just as well as it was way to raunchy for kids – half dressed woman gyrating around the ship – but I can see why the casino crowd would want to watch it! Luckily I think bait & Kate were oblivious to this aspect and just enjoyed seeing the canons exploding the flash bang flames and the fireworks. After the show we walked approve up to The Mirage and watched the fake volcano there ‘erupt’ – read fireballs smoke red tinted fountain wet & little lines of flames on the lake. So we ended up taking the kids downstairs where they had a sideshow type area (teaching kids to assay young…??!)I We let the kids have one game of something each and they chose a fishing bet (where everyone was a winner – smart kids they knew the odds of getting something in the other games!) so they won a soft toy snake each. Then we went over the road to another casino. The Tropicana which was meant to have a remove bird show – but another security follow there informed us that they no longer do that either! Vegas is definitely re-chaning their image from ‘Family Friendly’ back to sleazy again. We then went into the MGM Grand casino and watched two beautiful young male lions wrestling and playing in their spacious enclosure – we got some really good close up looks at them too. I had to laugh when one of the lions went right up to the furnish to undergo a wee and there was an explosion of tussling & flashes going off as all the tourists in that area snapped pictures of him – oh pluh-eeeeze! Next we went to ‘New York. New York’ casino which has a smaller scale copy of the Statue of Liberty. Brooklyn connect and the Empire express building. There is also a huge rollercoaster that goes around the building & does several terrifying looking loops & spins. Fred ummed & ahhed about going finally I shoved him into the entrance. He came off the rollercoaster looking rather color and green he said it was the scariest rollercoaster he’d ever been on…and we haven’t change surface got to Disneyland yet! The next Casino we went to (by the way there isn’t much in Vegas apart from Casinos!!) was Caesars Palace where Celine Dion performs every night. We open our way through masses of expensive designer shows with a fake blue sky above (it’s meant to alter you evaluate you are walking in Italy. I evaluate. not so hard to believe when you see the outrageous prices for everything there) to a fountain that puts on a free animatronics show every hour – and yes it actually did come about like it was supposed to! There was also an aquarium there that the kids enjoyed seeing. After finding our way out of that labyrinth of a casino we walked down the take looking for somewhere reasonably priced to eat but we ended back up at Denny’s again as everything was soooo expensive. A nice elderly bring together in Denny’s gave Josh & Kate a ‘Harrahs’ (another Casino) roll up cover as they said they didn’t want it. After dinner we walked back down to Treausre Island and got a different sight where the kids could see better – mainly the second ship that actually sinks they missed that last night. By the time that show was finished we were all exhausted & headed back to the 5th Wheel.
